GUARANTEE COUNTS:
A final count of attendance for food and beverage service must be submitted as set
forth within the Agreement. Once a final count is given [30 days prior UP TO 1 WEEK.], the Client will
be responsible for payment of that number even if fewer people attend the event. If
more are served, the actual number served will be charged at the per person cost
established in the Agreement. Boyle&Co. Catering will have sufficient food and
beverage available to accommodate 105% of the final count provided by the Client.

TIME SCHEDULE:
Client agrees to begin the event promptly at the agreed upon scheduled Event
“begin time” and BOYLE will vacate the facility at the indicated Event “end time”. The client
further agrees to pay overtime charges or other expenses incurred if the event
continues past the indicated Event End time.
LIABILITY
I, the client, understand that by hosting an event in my home/rental home etc, that
accidents/ breakage and damage may occur. I will NOT bill, charge or sue Boyle&Co
for any loss unless the damage or loss was caused by the willful negligent actions or
conduct of Boyle&Co. or it’s employees. Boyle&Co’s only liability, for third party
claims, will be for actions caused by Boyle&Co. and/ or the negligent conduct of it's
employees. BOYLE & CO will provice C.O.I upon request.
1THIRD PARTY LIABILITY + ALLERGIES:
Boyle&Co. Assumes no responsibility for the conduct of guests, members and third
parties hired to provide services. Boyle&Co is not held responsible for any
allergies that are not noted by the client on behalf of their guests.
BAR/ BEVERAGES:
Client assumes all responsibility for its guests and guests actions regarding the
consumption of alcoholic beverages and client will NOT bill, charge or sue Boyle&Co.
for any damage or loss caused by the willful negligent actions or conduct of guests
with regards to the consumption of alcohol. Boyle&Co will be providing beverage
service or Bar Support within your private residence in the following manner: Bar
Support. Bartender is certified with Sheriffs Card, SNHD Health Card and TAM Card.

Prices stated are subject to change according to the market price of products and
with final guaranteed number of guests. Boyle&Co. will inform Client of market price
changes no later than 14 days prior to the event. Client will have the option of
revising products and services to reduce costs prior to payment as described.
Boyle&Co. requires a mandatory 20% deposit to hold the date and staff.

Our services include Both food preparation and presentation,
We do NOT service or present third party prepared food.
​
(a) Should it become necessary for Client to terminate this Agreement, and the event date is greater than thirty (30) days, Caterer shall be entitled to retain any and all expenditures to date, including but not limited to contracted labor, special orders, rentals and/or proposals costs.
(b) If Agreement is terminated within thirty (21) days of the event, Caterer shall be entitled to retain twenty-five percent (25%) of deposit and seek any additional expenditures to date, including but not limited to contracted labor, special orders, rentals, and/or proposals costs.
(c) If Agreement is terminated within fourteen (14) days of the event Caterer shall be entitled to retain any deposit paid and seek any additional losses including but not limited to contracted labor, special orders, rentals and/or proposals costs.
(d) If an Agreement is drawn within five (5) days of the event, Client agrees to pay full event costs per bid
Should the event be cancelled by Caterer, Caterer will fully refund any deposit within ten (10) days of the date of cancellation. If event is within thirty (21) days, Caterer will reimburse or pay to Client the invoiced difference in costs and expenses that have been incurred by the Client paid to an alternative provider or providers based upon the total proposal bid. Client shall make reasonable efforts to mitigate damages and obtain substantially similar services. The caterers responsibility is limited to items covered in the last accepted proposal by Client. Any additional items are at Client’s expense.

(e) If the event is cancelled same day caterer is entitled to entire amount to cover staffing, purchased ingredient and labor.
